Posted May 05, 2018 12:50:23A federal court has ruled that the FCC must reclassify broadband Internet as an interstate utility and impose a tax on it to pay for its costs, clearing the way for the FCC to approve a proposed Internet tax that would finance public investment in new broadband infrastructure.
The ruling comes after the FCC voted to reclassification broadband in January after it was found to be a “telecommunications service” under the Communications Act.
The FCC originally ruled that broadband Internet is a “information service,” which meant it was exempt from state taxes.
However, the commission reversed that decision in a later ruling.
The commission is now reviewing its decision, and a decision is expected before the end of the year.
